Just about everyone agrees that reform is needed, but not everyone agrees on what “reform” means. To the House it means tougher enforcement. To the Senate it means enforcement plus a path to legalization for millions of undocumented immigrants and a guest-worker program for future arrivals. Any bill “comprehensive” enough to satisfy the Senate is unlikely to pass muster in the House; anything draconian enough for the House can’t win 60 votes in the Senate.

According to a briefing provided to Congress by the Federation for American Immigration Reform, the loophole exists in legislation passed by one vote in the House March 12. The bill, called the Enhanced Border Security and Visa Entry Reform Act of 2002, would reauthorize Section 245(i), a provision of the Immigration and Nationality Act that grants amnesty to illegal immigrants currently inside the U.S.

In its briefing, the group said it believes the statute could allow terrorists to apply for the 245(i) amnesty and current terrorist suspects to be released from custody.

“It’s baffling to think that Congress might actually pass a bill that inadvertently gives green cards to terrorists,” said Dan Stein, FAIR’s executive director. “The amnesty is another example of legislation which avoids the scrutiny of full public debate yet has far reaching – and in this case, politically deadly – consequences.”

No Instant Green Cards

Americans are often criticized for their shortsightedness. After reading John H. Cushman Jr.’s article [ “Illegal Workers: a Long Road to Legality,” Feb. 4 ] , I have to agree that we deserve this criticism.

In Mr. Cushman’s article, there are people who suggest that we give 80,000 green cards immediately to people who are waiting to work legally as baby sitters, instead of making them wait up to 15 years. This supposedly to solve the child-care shortage in this country.

What is the guarantee that these baby sitters would not look for other jobs that pay better once they have the right to work legally and wherever they want? If they choose to stop working and apply for welfare, are there any legal means to force them to continue to work as child-care providers?

Have we given thought to the cost of providing health care, education and housing for all the family members (and extended family members) of these sitters? What would be the impact of these newcomers on the American job market? CAROL FOX Alameda, Calif.

This Plan May Not Get A Green Card

The long-delayed immigration bill President George W. Bush proposed on Jan. 7 marks a dramatic and sweeping reprise of a key Administration policy that got sidelined in the wake of September 11. The Bush plan, which would grant temporary work status to millions of undocumented workers, will no doubt face a fight in Congress. But some kind of program to legitimize America’s vast illegal workforce stands a good chance of becoming law.

After all, repairing an all-but-broken immigration policy, which the Administration started to do before the 2001 terrorist attacks, would help many groups. Up to 10 million people now living illegally in the U.S. — the majority of them from Mexico — would be able to come out into the sunlight for the first time, working, renting, and driving without duplicity or fear. “We need to make our immigration laws more rational and more humane,” Bush said when he announced the plan.

But it’s not just workers who would benefit: Many employers would, too. They would no longer have to worry about federal raids and lawsuits alleging that they hire undocumented workers, like those that have hit companies such as Tyson Foods Inc. (TSN ) and Wal-Mart Stores Inc. (WMT ). More broadly, companies large and small would have a more stable supply of low-wage labor, with fewer hiring hassles and, most likely, less turnover. “If [undocumented workers] went home, we’d have to shut down this country” because there would be nobody to do their jobs, says U.S. Chamber of Commerce President Thomas J. Donahue, who supports the Administration’s plan.

Still, there are significant economic consequences involved in bringing 10 million illegal residents into the mainstream. Several studies have found that the large-scale flow of cheap labor into the U.S. has contributed to holding down wages among the working poor. While a guest worker program could temporarily boost labor costs by raising wages and benefits for formerly illegal workers, in the long run, it’s more likely to lower labor costs.
